Codification and Progressive Development of International Law

— Sixth Committee of the United Nations General Assembly

The Legal (Sixth) Committee is one of the six Main Committees of the United Nations General Assembly responsible for initiating studies and making recommendations for the purpose of encouraging the progressive development of international law and its codification.

During its’ sessions, the Sixth Committee considers issues of legal nature and proposes draft resolutions to the General Assembly.

The delegation of Belarus is traditionally actively participates in the sessions and comments on reports of the United Nations International Law Commission, UNCITRAL, Special Committee on the Charter of the United Nations and on the Strengthening of the Role of the Organization, rule of law on national and international levels, scope and application of the principle of universal jurisdiction etc.

Since 2013, the Republic of Belarus participates as an observer in the work of the Committee of Legal Advisers on Public International Law of the Council of Europe (CAHDI). The Committee is composed of the legal advisers of the Foreign Ministries of the Council of Europe Member States.

The CAHDI examines six major themes: immunities, outstanding reservations and declarations to treaties, national implementation measures of United Nations sanctions, case law of the European court of human rights related to public international law, peaceful settlement of disputes and international criminal justice.

The Committee meets twice a year and adopts a report after each meeting.

Among the key outcomes of CAHDI activities are the databases on the immunities of states and international organizations, the organization and functions of the Office of the Legal Adviser in the Ministry of Foreign Affairs and the implementation of United Nations sanctions with the observance of human rights.

The Consultative Committee was created in 2004 by the decision of the CIS Council of the Ministers of Foreign Affairs. It is comprised of legal advisors of the Ministries of Foreign Affairs of the CIS Participating States.

The Committee considers international legal issues of the CIS activities, experience and practice of the CIS Participating States in the field of international law, implementation of their international legal obligations, including relevant legislation, activities of other bodies and fora dealing with international law, supporting reaching joint approaches by the CIS States.

In particular, the Committee has elaborated and is updating the Manual for drafting CIS treaties, as well as the Manual for reviewing CIS treaties.

The 34th and the 35th  meetings of the Consultative Committee were held under the chairmanship of the Kyrgyz Republic in 2023.
